StreamLien Terms of Service

PLEASE READ THESE TERMS OF SERVICE CAREFULLY. THEY CONTAIN IMPORTANT PROVISIONS THAT AFFECT YOUR LEGAL RIGHTS, INCLUDING: (1) A DISCLAIMER THAT STREAMLIEN IS NOT A LAW FIRM AND DOES NOT PROVIDE LEGAL ADVICE (SECTION 3); (2) AN ALL-SALES-FINAL REFUND POLICY, INCLUDING SEPARATE RULES FOR PROPERTY-SEARCH AND MAILING ADD-ONS (SECTION 9); (3) TERMS GOVERNING OPTIONAL MAILING AND FULFILLMENT SERVICES, INCLUDING TIMING, USPS AND CARRIER RISK, AND A LIMITED SOLE REMEDY (SECTION 10); (4) A BINDING ARBITRATION PROVISION AND CLASS ACTION WAIVER (SECTION 22); AND (5) DISCLAIMERS OF WARRANTIES AND LIMITATIONS OF LIABILITY (SECTIONS 19 AND 20).

These Terms of Service (these "Terms") are a legally binding agreement between StreamLien, LLC ("StreamLien," "we," "us," or "our") and you, the person or entity accessing or using our services ("you," "your," or "User"). These Terms govern your access to and use of the StreamLien website located at streamlien.com, any related applications, tools, workflows, and features, and any documents, products, or services made available through them (collectively, the "Service").

Section 1

Acceptance of These Terms

By accessing or using the Service in any manner - including browsing the website, creating an account, submitting project or document information, making a purchase, certifying the accuracy of information, downloading a document, or using any document generated through the Service - you acknowledge that you have read, understood, and agree to be bound by these Terms and by our Privacy Policy, which is incorporated into these Terms by reference.

If you do not agree to these Terms, do not access or use the Service.

If you use the Service on behalf of a company or other entity, you represent and warrant that you have the authority to bind that entity to these Terms, and "you" and "User" refer to both you individually and that entity.

Additional or product-specific terms may apply to particular products, add-ons, or services we offer from time to time. Any such additional terms will be presented to you in connection with the applicable product or service and are incorporated into these Terms with respect to that product or service. If additional terms conflict with these Terms, the additional terms control for that product or service only.

Section 2

Description of the Service; Limited Scope

StreamLien provides self-serve, software-based construction document preparation tools for supported jurisdictions and workflows expressly shown in the applicable product or checkout flow. You create an account, enter the applicable project and document information, pay the applicable fee, certify the accuracy of the information you provided, and download a final document. The specific documents, products, forms, and features available to you at any time - which may change from time to time - are those expressly shown in the applicable product or checkout flow. These Terms apply to all documents, products, and services made available through the Service.

The Service generates documents based solely on the information you provide. StreamLien helps you prepare documents from your information using templates and workflows; it does not guarantee legal sufficiency, enforceability, preservation or perfection of lien rights, payment, collection, or any legal or business outcome.

StreamLien currently offers, and may from time to time add, change, or remove, document types, jurisdictions, and operational add-ons, including property search and owner lookup, certified-mail fulfillment, expedited handling, additional document workflows, and document review. Any such offerings are available only if and as expressly shown in the product or checkout flow, and may be subject to additional terms and fees. Nothing in these Terms obligates StreamLien to offer, or entitles you to receive, any product, feature, or service not expressly purchased by you.

We may modify, suspend, or discontinue any part of the Service, or any feature, template, or workflow, at any time.

Scope of documents. Except for optional fulfillment services that StreamLien expressly offers and you separately purchase as described in Section 10, StreamLien only prepares a document from the information you provide, regardless of the document type or workflow. StreamLien does not sign, notarize, verify, file, record, or deliver any document for you; does not decide which document is appropriate for your situation; and does not determine, calculate, or track whether any deadline applies. Where you purchase a fulfillment service, StreamLien performs only the ministerial mailing task described in Section 10, at your direction and on your behalf. StreamLien does not determine, and does not represent, that mailing is a permitted or legally sufficient method of notice, service, or delivery for your document, your project, or your circumstances, or that any mailing satisfies any notice or service requirement applicable to you. You are solely responsible for selecting the correct document for your needs, for the accuracy of the information it contains, for signing and, where required, having it notarized, and for serving, mailing, filing, recording, or otherwise delivering it as and when required, except to the extent StreamLien performs a fulfillment service you have separately purchased under Section 10 and subject in all respects to that Section. This scope is subject to the disclaimers, limitations, and responsibilities stated elsewhere in these Terms, including Sections 3, 4, 5, 9, 10, and 12.

Section 3

No Legal Advice; No Attorney-Client Relationship

STREAMLIEN IS NOT A LAW FIRM. THE SERVICE DOES NOT PROVIDE LEGAL ADVICE, LEGAL OPINIONS, OR LEGAL REPRESENTATION. YOUR USE OF THE SERVICE DOES NOT CREATE AN ATTORNEY-CLIENT RELATIONSHIP BETWEEN YOU AND STREAMLIEN OR BETWEEN YOU AND ANY PERSON AFFILIATED WITH STREAMLIEN.

Without limiting the foregoing:

The Service is a self-serve software tool. Purchase of any product through the Service does not include attorney review, legal analysis, or legal advice of any kind unless separately agreed in a signed written engagement agreement.

StreamLien does not represent you in any legal matter and does not evaluate legal strategy, deadlines, lien rights, notice or filing requirements, project-specific legal risk, or disputes.

You are solely responsible for deciding whether any document is required, appropriate, timely, complete, and properly signed, notarized, sent, served, filed, or recorded for your project.

Communications with StreamLien support are limited to technical, account, payment, and document-generation matters and are not legal advice.

If attorney services are ever offered in connection with the Service, they will require a separate written engagement agreement, conflict check, and separate terms and fees, and will not be governed by these Terms except as expressly stated.

Attorney affiliation. StreamLien is owned and operated by a person licensed to practice law in the State of California. That person does not act as your attorney in connection with the Service, does not provide legal advice through the Service, and does not review your documents for legal sufficiency. No attorney-client relationship is created by your use of the Service, by your purchase of any product or add-on, by any communication with StreamLien support, or by StreamLien’s performance of any fulfillment service. Any attorney-client relationship requires a separate signed engagement agreement, a conflict-of-interest check, and separate terms and fees.

You should consult a qualified attorney licensed in the relevant jurisdiction about deadlines, exceptions, lien rights, service and mailing requirements, disputes, unusual project facts, or any other legal question.

The documents available through the Service can have significant legal and financial consequences - for example, creating a recorded claim against real property, or affecting, waiving, releasing, or extinguishing lien or payment rights. StreamLien's role is strictly limited to software-based preparation of documents from the information you provide. Nothing in the Service, and no document generated through it, is legal advice or a substitute for advice from a qualified attorney licensed in the relevant jurisdiction.

Section 4

Your Responsibility for Information; Certification

You are solely responsible for the accuracy, completeness, and truthfulness of all information you submit to the Service. StreamLien relies entirely on the information you provide to generate documents and does not independently verify it. Information for which you are responsible includes, without limitation: the project/property address; owner name and mailing address; your customer's or contracting entity's name and address; direct contractor or general contractor information; construction lender information, if any; the description of work; furnishing dates; contract values and amounts; contact information; any mailing, service, or recipient addresses; and, where you purchase a fulfillment service, your selection and approval of the specific recipient names and mailing addresses to be used.

You must review the full content of each document before certifying, downloading, mailing, serving, recording, filing, or otherwise relying on it. Your certification within the Service is a binding representation by you that you have reviewed the information and believe it to be true and correct. Do not certify a document unless that is the case.

Recipient data. If you purchase a fulfillment service, you represent and warrant that you have the right to provide StreamLien with the recipient names and addresses you submit, that those recipients are the correct and complete set of parties to whom the document should be sent, and that the addresses are current and correct. StreamLien will use only the recipient names and addresses you have approved within the Service, exactly as approved, and will not select, add, remove, verify, supplement, or correct any recipient or address.

StreamLien is not responsible for any error, omission, defect, or consequence arising from incorrect, incomplete, outdated, ambiguous, or misleading information you provide, or from your failure to review a document before using it. No refund, credit, re-performance, correction, or other obligation of any kind arises from information you submitted or certified that was incorrect, incomplete, outdated, or misidentified, including an incorrect or misidentified owner, project, property, hiring party, direct contractor, lender, recipient, or mailing address.

Section 5

Document Generation Limitations

Documents are generated from templates, automated workflows, and the data you submit. The Service may perform automated validation or formatting checks, but such checks are technical in nature only; they are not legal review and do not guarantee legal sufficiency, accuracy, or compliance.

You acknowledge and agree that:

A generated document may not be appropriate for every project, party, deadline, contract, jurisdiction, or factual circumstance.

StreamLien does not guarantee that any document will preserve, perfect, enforce, or protect lien rights or any other legal right or remedy.

StreamLien does not guarantee that any document will be accepted by any owner, contractor, lender, agency, recorder, carrier, court, or other third party.

You are solely responsible for deciding whether and how to use any generated document.

StreamLien may refuse, block, or require correction of submissions that are incomplete or that fail validation checks.

Section 6

Supported Jurisdictions; Product Scope

Each StreamLien document workflow is designed and intended only for the jurisdiction, document type, and project scope expressly identified in the applicable product or checkout flow. You must not use a form or workflow for a project, jurisdiction, document type, or legal context that is outside the scope shown for that product.

Support for any state, jurisdiction, or document type is limited to what StreamLien expressly identifies in the product or checkout flow. StreamLien is not responsible for any consequence of your use of a document in an unsupported jurisdiction, for the wrong project type, in the wrong legal context, or otherwise outside the product's stated scope.

Section 7

Accounts, Eligibility, and Security

You may be required to create an account to use, purchase, or download documents through the Service. You agree to:

Provide accurate, current, and complete account and contact information, and keep it updated.

Maintain the confidentiality and security of your login credentials, and accept responsibility for all activity that occurs under your account.

Notify StreamLien promptly at support@streamlien.com of any unauthorized access to or use of your account or any other security concern.

You must be at least 18 years old and capable of forming a binding contract to use the Service. StreamLien may suspend or terminate your account or access for misuse, fraud, abuse, unlawful use, security risk, nonpayment, chargebacks, or any violation of these Terms.

Section 8

Payments and Checkout

Pricing for each product is displayed at checkout. Payment is required before final document generation and download, where applicable. By submitting payment, you authorize StreamLien and/or its payment processor to charge your selected payment method for the total amount shown at checkout, including any applicable taxes or fees.

Add-on services. Optional add-on services, including property search and owner lookup, certified-mail fulfillment, and expedited handling, are separately purchased and are charged at the prices shown at checkout at the time of purchase. Fulfillment fees cover StreamLien’s handling only; postage and carrier charges are stated separately at checkout and charged in addition. In these Terms, Fulfillment Charges means, collectively, the StreamLien handling fee and the postage and carrier charges for a given item. StreamLien may change add-on pricing prospectively at any time, including in response to changes in carrier or third-party data rates. Purchase of one product or add-on does not entitle you to any other product or add-on.

Payments are processed by third-party payment processors. StreamLien does not store full payment card numbers. Your use of a payment processor may be subject to that processor's own terms and privacy policy.

Failed, reversed, disputed, or fraudulent payments may result in suspension of your account, withholding of access to documents or services, cancellation of services, and/or collection action. You are responsible for any taxes, processing fees, or other charges associated with your purchase, if any.

StreamLien may correct pricing errors or product-description errors, including after an order is submitted, in which case you will be given the opportunity to cancel the affected order for a refund of amounts paid for that order.

Section 9

All Sales Final; Refunds; Chargebacks

ALL SALES ARE FINAL. EXCEPT AS REQUIRED BY APPLICABLE LAW, ALL PURCHASES THROUGH THE SERVICE ARE NON-REFUNDABLE.

Document-preparation fees. Once a final document has been generated or made available to you for download, the document-preparation fee for that document is fully earned and non-refundable, except as required by applicable law or as StreamLien voluntarily elects under this Section. This is true whether or not you download the document, use it, or determine after generation that it was not the document you needed.

Without limiting the foregoing, no refund will be provided for, and StreamLien has no liability arising from:

Incorrect, incomplete, or inaccurate information you provided.

Your failure to review a document before certification or download.

Your misunderstanding of legal requirements, deadlines, or the scope of the product.

Use of a document outside the supported jurisdiction or otherwise outside the product's stated scope.

Missed deadlines of any kind.

Delays or failures caused by third parties or events outside StreamLien's control.

Completed, generated, or downloaded document products.

Property search or owner-lookup fees, once the search has been performed or the results have been made available to you, regardless of whether the results are complete, current, accurate, or usable.

StreamLien may, in its sole discretion, correct technical errors, regenerate documents, or issue a refund or credit in a particular case; any such accommodation is voluntary and does not waive this Section or entitle you or anyone else to the same accommodation in the future.

Fulfillment fees. The following applies to certified-mail fulfillment, expedited handling, and any other fulfillment add-on purchased under Section 10.

(a) Before fulfillment begins. If you request cancellation by contacting support@streamlien.com before StreamLien has printed the document, purchased or applied postage, deposited the item with a carrier, or otherwise begun the fulfillment task, StreamLien may, in its sole discretion, cancel the add-on and refund the fulfillment fee paid for the cancelled item, together with any postage or carrier charges for that item that StreamLien has not yet incurred. A cancellation request is effective only when actually received and acknowledged by StreamLien. StreamLien has no obligation to monitor for, or to act on, cancellation requests sent by any other means, and no obligation to interrupt fulfillment already in progress.

(b) After fulfillment begins. Once StreamLien has printed the document, purchased or applied postage, deposited the item with a carrier, or otherwise begun the fulfillment task, the Fulfillment Charges for that item are fully earned and non-refundable. Without limiting the foregoing, no refund will be provided for: recipient names or addresses you selected or approved that were incorrect, incomplete, or outdated; carrier or USPS delay, loss, misdelivery, damage, non-scanning, or unavailable or inaccurate tracking; recipient refusal, non-acceptance, or returned or undeliverable mail; your determination after mailing that the document, its content, its recipients, its method of delivery, or its timing was legally insufficient; or your determination after mailing that you no longer needed the document mailed.

(c) Voluntary accommodations. StreamLien may, in its sole discretion, re-mail, correct, credit, or refund in a particular case. Any such accommodation is voluntary, does not waive this Section, and does not entitle you or anyone else to the same accommodation in the future. This subsection (c) does not limit the express limited remedy in Section 10.

If you experience a problem with a purchase, contact support@streamlien.com and give StreamLien a reasonable opportunity to address the issue before initiating any chargeback or payment dispute. You agree not to initiate a chargeback for issues attributable to your own information, review, or use of a document. Chargeback abuse may result in account suspension or termination and collection action.

Section 10

Mailing, Service, Filing, and Recording; Optional Fulfillment Services

Unless expressly stated otherwise at checkout, your purchase of a self-serve document does NOT include mailing, certified mail, postage, service of the document on any party, filing, recording, or delivery of any kind, except as expressly provided below for fulfillment services you separately purchase. This applies to every document made available through the Service. StreamLien does not record any document with any county recorder or other office; does not serve or mail any document on or to any owner, contractor, lender, or other party; and does not file or deliver any document with or to any court, agency, or other third party - unless StreamLien separately offers that specific fulfillment service and you separately purchase and approve it.

You are solely responsible for any mailing, service, filing, recording, or delivery of documents, including selecting the correct recipients and addresses, the method of service, and the timing, unless StreamLien separately offers a fulfillment service and you separately purchase and approve it.

Certified-mail fulfillment. If StreamLien offers and you separately purchase a certified-mail fulfillment add-on, StreamLien will, for the specific document and the specific recipients you have approved within the Service: (a) print the final generated document; (b) deposit it with the United States Postal Service for delivery by USPS Certified Mail, addressed to the recipient names and addresses you approved; (c) record the USPS tracking number or numbers in your account; and (d) make those tracking numbers available to you through the Service. This is the complete and exclusive scope of the fulfillment service. StreamLien does not effect personal service or service of process, does not act as a process server, registered agent, or agent for service of process, does not select, verify, supplement, or correct recipients or addresses, and does not perform any recording, filing, or delivery other than the mailing expressly described in this paragraph. Where applicable law permits a notice or document to be given or served by mail, StreamLien’s deposit of the item with USPS is performed at your direction and on your behalf as a ministerial act only; whether that mailing constitutes valid or timely notice or service is solely your responsibility to determine.

Availability of fulfillment by document type. Fulfillment services are available only for those document types for which StreamLien expressly offers fulfillment in the applicable product or checkout flow. Fulfillment is not available for every document made available through the Service, and the absence of a fulfillment option for a document type is not an indication that mailing, service, or delivery is unnecessary for that document. StreamLien may add, limit, or discontinue fulfillment availability for any document type at any time. If you purchase a fulfillment service for a document type for which it is not offered, StreamLien may decline or cancel that fulfillment service and refund the Fulfillment Charges paid for that item, and StreamLien has no other obligation or liability in connection with that item.

NO FULFILLMENT GUARANTEES. STREAMLIEN DOES NOT GUARANTEE, AND EXPRESSLY DISCLAIMS ANY WARRANTY OR REPRESENTATION REGARDING: USPS OR CARRIER ACCEPTANCE, DELIVERY, DELIVERY DATE, OR HANDLING; THE AVAILABILITY, ACCURACY, TIMELINESS, OR UPDATING OF TRACKING INFORMATION; THE EXISTENCE, GENERATION, OR RETENTION OF ANY DELIVERY SCAN, RETURN RECEIPT, OR PROOF OF DELIVERY; RECIPIENT RECEIPT, ACCEPTANCE, OR REFUSAL; THE CORRECTNESS OR COMPLETENESS OF ANY RECIPIENT NAME OR ADDRESS YOU APPROVED; THE LEGAL SUFFICIENCY OF CERTIFIED MAIL, OR OF ANY OTHER METHOD, AS A MEANS OF NOTICE, SERVICE, OR DELIVERY FOR YOUR DOCUMENT OR PROJECT; THE PRESERVATION, PERFECTION, OR PROTECTION OF LIEN OR PAYMENT RIGHTS; OR COMPLIANCE WITH ANY LEGAL DEADLINE.

Fulfillment timing. Any timing shown at checkout or elsewhere in the Service describes when StreamLien will deposit the item with USPS, and does not describe or promise when USPS will deliver it. StreamLien makes no representation as to any delivery date.

Start of the timing window. StreamLien's timing window begins only when all of the following have occurred: you have completed the applicable intake; you have certified the information; you have approved the recipient names and addresses; you have paid in full; and the final document has been generated. Any delay in your completion of these steps postpones the start of the window. StreamLien is not responsible for any delay attributable to incomplete intake, failed or disputed payment, or your failure to approve recipients or addresses.

Cutoff and business days. The daily cutoff is 1:30 P.M. Pacific Time. All times stated in these Terms and in the Service are Pacific Time. Business day means Monday through Friday, excluding federal holidays and any day on which USPS retail or acceptance operations are unavailable. An item for which the timing window begins after the stated cutoff, or on a weekend or holiday, is treated as beginning on the next business day.

Stated windows. Subject to the foregoing, StreamLien will deposit the item with USPS: for standard fulfillment, no later than two (2) business days after the timing window begins; and for expedited fulfillment, on the same business day that the timing window begins.

No deadline guarantee. StreamLien does not guarantee any USPS delivery date and makes no representation that mailing within any stated window will satisfy, or contribute to satisfying, any legal deadline, notice requirement, or service requirement applicable to you.

Returned or undeliverable mail. If an item is returned, refused, unclaimed, or cannot be delivered, StreamLien will make the fact of return available to you if and when StreamLien receives notice of it, but has no obligation to re-mail the item, investigate the cause, locate or research an alternative recipient or address, notify you within any particular time, or refund any fee. Re-mailing to any recipient or address, including a corrected one, is a new fulfillment service subject to a new fee.

Proof of mailing. StreamLien will make available to you the USPS tracking number for each item it mails and, where StreamLien receives it, USPS-generated proof of mailing or delivery status information. StreamLien does not prepare, execute, sign, or provide any affidavit, declaration, certificate, or proof of service or of notice, and does not represent that any USPS-generated record will satisfy any statutory or evidentiary proof requirement applicable to your document. You are solely responsible for obtaining, preparing, and preserving any proof of service, proof of notice, or supporting affidavit or declaration required for your project. StreamLien does not guarantee indefinite retention of tracking numbers, mailing records, or generated documents and may delete them consistent with its then-current retention practices. You should download and independently retain your own copies of all documents and tracking information.

Documents requiring proof of service by the sender. Some documents require, as a condition of their validity, recording, or enforceability, a proof of service, affidavit, or declaration executed by the person who actually served or mailed the document. StreamLien does not execute or provide any such proof, affidavit, or declaration. If your document is or may be subject to such a requirement, you must not rely on any StreamLien fulfillment service to satisfy it. You are solely responsible for determining whether such a requirement applies to your document and for satisfying it, including by serving or mailing the document yourself so that you can execute the required proof. If you are uncertain whether your document is subject to such a requirement, consult a qualified attorney licensed in the relevant jurisdiction before purchasing any fulfillment service.

Limited remedy for fulfillment error. If StreamLien fails to mail an item you purchased, or mails it to a recipient or address other than the one you approved within the Service, and you notify StreamLien at support@streamlien.com within thirty (30) days after the date StreamLien indicates the item was mailed or was scheduled to be mailed, StreamLien will, at its sole option and as your sole and exclusive remedy, either (a) re-perform the fulfillment service at no additional charge, or (b) refund the Fulfillment Charges paid for the affected item. This remedy does not apply to any consequence of information you provided or approved, or to any act or omission of USPS or any other carrier. This remedy is subject in all respects to Sections 19 and 20, including the limitation of liability and the liability cap.

No assumption of legal responsibility. StreamLien’s performance of any fulfillment service is a ministerial printing and mailing task only. It does not constitute legal advice, legal review, service of process, or any determination that the document, its content, its recipients, its method of delivery, or its timing is correct, complete, appropriate, sufficient, or timely. It does not create an attorney-client relationship, and it does not transfer to StreamLien any responsibility for deadlines, notice requirements, service requirements, lien rights, or legal outcomes, all of which remain solely yours.

Section 11

Property Search, Owner Lookup, and Third-Party Data

StreamLien offers, and may modify or discontinue, property search and owner/address lookup tools and add-ons. Data used by such tools may come from public records, county records, or third-party data providers, and may be incomplete, outdated, inaccurate, duplicated, or mismatched.

Any property search or lookup feature is assistive only. You must independently review and verify all owner, address, and property information before using it in any document or service workflow. StreamLien does not guarantee property search results, and property search is not a substitute for legal review or professional title or public-record research unless separately agreed in writing. Additional fees may apply to property search or lookup features.

Property search and owner-lookup fees are charged for performing the search or lookup and making the result available to you. They are not charged for, and do not constitute, any guarantee that the data returned is complete, current, accurate, legally correct, or sufficient for any purpose. You must not use any property search or lookup result in any document, notice, or filing without independently verifying it against the county records or other authoritative source. StreamLien does not warrant that any owner name, address, parcel identification, or property description returned is the legally correct party, address, or description for your document or project.

Section 12

Deadlines, Timing, and Planning

You are solely responsible for determining and meeting all legal deadlines applicable to your project and documents, including any notice, recording, filing, service, enforcement, and foreclosure deadlines. StreamLien does not calculate, track, remind you of, or manage any deadline for you, and does not guarantee that any document is timely for any particular project or legal requirement. Many construction-related deadlines are strict and unforgiving, and missing them can permanently eliminate your rights. Unless and until StreamLien expressly offers a customer-facing deadline-tracking feature and you purchase or enable it, you must not rely on the Service to identify, calculate, or track any deadline.

Website availability, payment processing, document generation, email delivery, and download access may be delayed or interrupted by technical or third-party issues. Do not wait until the last moment to prepare, send, serve, file, or record legally significant documents. Carrier and government processing times affect delivery, are outside StreamLien’s control, and are not included in any of StreamLien’s operational timing windows.

Fulfillment does not shift deadline responsibility. If you purchase a fulfillment service, StreamLien’s deposit of the document with USPS within any stated operational window does not mean the mailing is timely, sufficient, or effective for any legal purpose. You remain solely responsible for determining every applicable deadline, for determining whether the date of mailing satisfies that deadline, and for allowing adequate time for intake, certification, document generation, StreamLien’s fulfillment, and carrier transit. Do not purchase a fulfillment service in reliance on StreamLien’s operational window to meet a deadline, and do not treat StreamLien’s performance of a fulfillment service as confirmation that your timing is legally sufficient.

Section 13

Communications and Email Notices

You consent to receive transactional and operational communications from StreamLien relating to your account, saved drafts, payments, document readiness, fulfillment status and tracking information, support requests, service updates, security, legal notices, and similar matters, including by email. You must maintain a current, working email address on your account.

Email delivery is not guaranteed and may fail due to spam filters, provider outages, incorrect addresses, or other third-party systems. Some optional communications may be configurable in your account settings, but StreamLien may still send necessary transactional, legal, security, or service-related notices.

Section 14

Privacy

StreamLien collects and processes account, project, property, payment-status, document, fulfillment and mailing, tracking, first-party analytics, support, and communication data, including recipient names and contact information you provide, in order to provide the Service. Payment card information is handled by third-party payment processors, not by StreamLien. StreamLien uses third-party vendors and service providers for hosting, authentication, database and storage, email delivery, payment processing, error monitoring, property data, printing, mailing and certified-mail workflows, and related operations. StreamLien does not use third-party analytics providers for cross-context behavioral advertising.

Our Privacy Policy, available on the StreamLien website, governs our collection, use, sharing, and retention of personal information and is incorporated into these Terms by reference.

Section 15

Acceptable Use

You agree not to use the Service to, and not to:

Violate any applicable law or regulation, or use the Service for any unlawful, fraudulent, abusive, or misleading purpose.

Submit false, deceptive, or misleading information, or create or transmit fraudulent or deceptive documents.

Use generated documents for harassment, fraud, extortion, or any illegal purpose.

Infringe or violate the intellectual property, privacy, or other rights of any third party.

Interfere with or disrupt the security, availability, or integrity of the Service or connected servers or networks.

Scrape, crawl, bulk copy, or harvest content or data from the Service, or access the Service by automated means, without StreamLien's express written permission.

Reverse engineer, decompile, or disassemble any portion of the Service, or attempt to gain unauthorized access to any portion of the Service or another user's account.

Share, sell, or abuse credentials, or upload malware or other harmful code or content.

StreamLien may investigate suspected violations and may suspend or terminate accounts that violate this Section.

Section 16

Intellectual Property; License to Generated Documents

StreamLien and its licensors own the Service, including the website, software, workflows, forms, templates, designs, branding, logos, text, and all other intellectual property, which are protected by copyright, trademark, and other laws. Except for the limited license below, no right, title, or interest in the Service is transferred to you.

License to you. Upon full payment, StreamLien grants you a limited, non-exclusive, non-transferable, non-sublicensable license to use each purchased generated document for your own project and internal business purposes. You may not copy, resell, sublicense, redistribute, or commercialize StreamLien templates or workflows, use them to create a competing product or service, or remove any StreamLien attribution or notices from templates (generated documents intended for third-party recipients are excluded from any attribution requirement).

Your content. You retain ownership of the information you submit. You grant StreamLien a non-exclusive, worldwide, royalty-free license to store, process, transmit, and use that information as necessary to provide the Service, support, security, compliance, analytics, and service improvement, consistent with our Privacy Policy.

Section 17

Third-Party Services and Vendors

The Service relies on third-party vendors and services, which may include payment processors, hosting providers, authentication/database/storage providers, email providers, error-monitoring providers, property-data providers, carriers, printing and mailing vendors, tracking-data providers, and other operational vendors. Third-party services are subject to their own terms and privacy policies.

StreamLien is not responsible for third-party outages, delays, errors, suspensions, unavailable APIs, rejected transactions, email delivery failures, or carrier, government, or vendor issues beyond StreamLien's reasonable control. Without limiting the foregoing, StreamLien is not responsible for carrier delay, loss, misdelivery, damage, non-delivery, failure to scan, unavailable or inaccurate tracking data, refused, unclaimed, or returned mail, or carrier or government service outages, whether or not you purchased a fulfillment service.

Section 18

Availability, Modifications, and Corrections

The Service is provided subject to availability. Access may be interrupted for maintenance, outages, security measures, vendor issues, or updates. StreamLien may correct errors, update templates and workflows, change pricing, modify the Service, or discontinue features at any time. StreamLien may refuse, cancel, or suspend any order or service for technical, legal, operational, fraud-prevention, payment, or compliance reasons.

Section 19

Disclaimer of Warranties

THE SERVICE, AND ALL DOCUMENTS, DATA, AND CONTENT PROVIDED THROUGH IT, ARE PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. TO THE FULLEST EXTENT PERMITTED BY LAW, STREAMLIEN DISCLAIMS ALL WARRANTIES, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT.

WITHOUT LIMITING THE FOREGOING, STREAMLIEN DOES NOT WARRANT THAT: (A) THE SERVICE WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE; (B) ANY DOCUMENT WILL BE LEGALLY SUFFICIENT, ENFORCEABLE, OR COMPLIANT IN ANY PARTICULAR CIRCUMSTANCE; (C) ANY DOCUMENT WILL PRESERVE, PERFECT, OR PROTECT LIEN RIGHTS OR RESULT IN PAYMENT OR COLLECTION; (D) ANY DOCUMENT WILL BE ACCEPTED BY ANY RECIPIENT, COURT, AGENCY, RECORDER, CARRIER, OR OTHER THIRD PARTY; (E) ANY THIRD-PARTY SERVICE OR DATA WILL BE ACCURATE, AVAILABLE, OR TIMELY; OR (F) ANY MAILING OR FULFILLMENT SERVICE WILL BE DELIVERED, TIMELY, TRACKED, DOCUMENTED, ACCEPTED, OR LEGALLY SUFFICIENT AS A METHOD OF NOTICE, SERVICE, OR DELIVERY.

Some jurisdictions do not allow the exclusion of certain warranties, so some of the above exclusions may not apply to you.

Section 20

Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, STREAMLIEN AND ITS MEMBERS, MANAGERS, OFFICERS, EMPLOYEES, CONTRACTORS, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, CONSEQUENTIAL, SPECIAL, PUNITIVE, OR EXEMPLARY DAMAGES, OR FOR ANY LOST PROFITS, LOST REVENUE, LOST BUSINESS, LOSS OF DATA, OR LOSS OF GOODWILL, ARISING OUT OF OR RELATED TO THE SERVICE OR THESE TERMS, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

WITHOUT LIMITING THE FOREGOING, STREAMLIEN SHALL NOT BE LIABLE FOR ANY DAMAGES ARISING FROM: LOST OR UNPERFECTED LIEN RIGHTS; MISSED DEADLINES; REJECTED OR UNACCEPTED DOCUMENTS; LEGAL DISPUTES; NONPAYMENT BY ANY PARTY; THIRD-PARTY CLAIMS; INCORRECT OR INCOMPLETE USER-PROVIDED INFORMATION; USER MISUSE OF THE SERVICE OR ANY DOCUMENT; THIRD-PARTY DATA ERRORS; CARRIER, VENDOR, OR GOVERNMENT DELAYS; FAILED, DELAYED, LOST, MISDELIVERED, REFUSED, UNCLAIMED, OR RETURNED MAIL; UNAVAILABLE OR INACCURATE TRACKING INFORMATION; ANY FULFILLMENT ERROR, OMISSION, OR FAILURE BY STREAMLIEN; OR SERVICE DOWNTIME.

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, STREAMLIEN'S TOTAL AGGREGATE LIABILITY FOR ALL CLAIMS ARISING OUT OF OR RELATED TO THE SERVICE OR THESE TERMS SHALL NOT EXCEED THE AMOUNT YOU ACTUALLY PAID TO STREAMLIEN FOR THE SPECIFIC PRODUCT OR SERVICE GIVING RISE TO THE CLAIM, OR ONE HUNDRED DOLLARS ($100) IF NO SUCH AMOUNT WAS PAID. FOR THE AVOIDANCE OF DOUBT, WHERE A CLAIM ARISES OUT OF OR RELATES TO A PROPERTY SEARCH, OWNER LOOKUP, CERTIFIED-MAIL FULFILLMENT, EXPEDITED HANDLING, OR OTHER ADD-ON SERVICE, THE AMOUNT YOU ACTUALLY PAID FOR THAT SPECIFIC ADD-ON SERVICE, INCLUDING ANY FULFILLMENT CHARGES FOR THE AFFECTED ITEM, IS THE APPLICABLE CAP, AND AMOUNTS PAID FOR ANY OTHER PRODUCT OR SERVICE ARE EXCLUDED FROM THE CALCULATION OF THAT CAP.

Nothing in these Terms limits or excludes liability that cannot be limited or excluded under applicable law, and these limitations apply only to the fullest extent permitted by applicable law. Some jurisdictions do not allow the limitation of certain damages, so some of the above limitations may not apply to you.

Section 21

Indemnification

You agree to defend, indemnify, and hold harmless StreamLien and its members, managers, officers, employees, contractors, and agents from and against any claims, demands, damages, losses, liabilities, costs, and expenses (including reasonable attorneys' fees) arising out of or relating to:

Information you provide to the Service.

Your certification or your use of any generated document.

Your mailing, service, filing, recording of, or reliance on any document.

The recipient names, addresses, and approvals you submit or approve for any fulfillment service, and StreamLien’s performance of that fulfillment service in accordance with them.

Any claim by any recipient of a document StreamLien mailed at your direction, including any claim relating to the content, accuracy, or effect of that document.

Your violation of these Terms, applicable law, third-party rights, or the stated scope of any product.

Any dispute between you and any owner, contractor, lender, agency, customer, carrier, or other third party.

Fraudulent transactions, chargebacks, or misuse of the Service attributable to you or your account.

StreamLien reserves the right, at your expense, to assume the exclusive defense and control of any matter subject to indemnification by you, in which case you agree to cooperate with StreamLien's defense.

Section 22

Governing Law; Dispute Resolution; Arbitration; Class Waiver

PLEASE READ THIS SECTION CAREFULLY. IT REQUIRES ARBITRATION OF MOST DISPUTES ON AN INDIVIDUAL BASIS AND WAIVES YOUR RIGHT TO A JURY TRIAL AND TO PARTICIPATE IN A CLASS ACTION.

Governing law. These Terms and any dispute arising out of or related to them or the Service are governed by the laws of the State of California, without regard to its conflict of law provisions. The Federal Arbitration Act governs the interpretation and enforcement of the arbitration provisions of this Section.

Informal resolution first. Before initiating any arbitration or court proceeding, you and StreamLien each agree to first send the other a written notice of the dispute describing the claim and the relief sought (to StreamLien at support@streamlien.com), and to attempt in good faith to resolve the dispute informally for at least thirty (30) days after the notice is received.

Binding arbitration. Except as provided below, any dispute, claim, or controversy arising out of or relating to these Terms or the Service that is not resolved informally shall be resolved by final and binding arbitration administered by JAMS under its Streamlined Arbitration Rules and Procedures then in effect. The arbitration shall be conducted by a single arbitrator in San Diego County, California, or, at the option of both parties, by videoconference or on written submissions. Judgment on the arbitration award may be entered in any court of competent jurisdiction. Each party bears its own attorneys' fees and costs except where the arbitrator awards them under applicable law or the JAMS rules, and arbitration fees will be allocated in accordance with the JAMS rules and applicable law.

Exceptions. Either party may (a) bring an individual claim in small claims court in San Diego County, California (or, if you are a consumer, in the small claims court of your county of residence) if the claim qualifies, and (b) seek injunctive or other equitable relief in a court of competent jurisdiction to protect its intellectual property rights or to prevent unauthorized access to or abuse of the Service.

CLASS ACTION WAIVER. YOU AND STREAMLIEN AGREE THAT EACH MAY BRING CLAIMS AGAINST THE OTHER ONLY IN AN INDIVIDUAL CAPACITY, AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS, COLLECTIVE, CONSOLIDATED, OR REPRESENTATIVE PROCEEDING. THE ARBITRATOR MAY NOT CONSOLIDATE CLAIMS OF MORE THAN ONE PERSON AND MAY NOT PRESIDE OVER ANY FORM OF CLASS OR REPRESENTATIVE PROCEEDING. IF THIS CLASS ACTION WAIVER IS FOUND UNENFORCEABLE AS TO A PARTICULAR CLAIM, THAT CLAIM (AND ONLY THAT CLAIM) SHALL PROCEED IN COURT AS SET FORTH BELOW, AND THE WAIVER SHALL REMAIN IN EFFECT FOR ALL OTHER CLAIMS.

JURY TRIAL WAIVER. TO THE FULLEST EXTENT PERMITTED BY LAW, YOU AND STREAMLIEN EACH WAIVE THE RIGHT TO A TRIAL BY JURY FOR ANY DISPUTE THAT PROCEEDS IN COURT.

Venue for non-arbitrable claims. Any claim that is not subject to arbitration under this Section shall be brought exclusively in the state or federal courts located in San Diego County, California, and you and StreamLien each consent to the personal jurisdiction of those courts.

Time limit. To the fullest extent permitted by applicable law, any claim arising out of or related to these Terms or the Service must be commenced within one (1) year after the claim accrues; otherwise it is permanently barred.

Section 23

Termination; Survival

You may stop using the Service and close your account at any time by contacting support@streamlien.com or through account settings, if available. StreamLien may suspend or terminate your access to the Service at any time for Terms violations, nonpayment, fraud, abuse, security risk, legal or compliance concerns, misuse, or any other reason, with or without notice.

Termination does not eliminate any payment obligation you have incurred or any restriction that by its nature should survive. The following Sections survive termination: Sections 3 (No Legal Advice), 4 (Your Responsibility), 5 (Document Generation Limitations), 9 (All Sales Final; Refunds; Chargebacks), 10 (Mailing, Service, Filing, and Recording; Optional Fulfillment Services), 11 (Property Search, Owner Lookup, and Third-Party Data), 12 (Deadlines, Timing, and Planning), 16 (Intellectual Property), 19 (Disclaimer of Warranties), 20 (Limitation of Liability), 21 (Indemnification), 22 (Dispute Resolution), and 26 (Miscellaneous), together with any other provision that by its nature should survive.

Support and Notices

Support requests may be sent to support@streamlien.com. Support is limited to technical, account, payment, and document-generation matters and does not include legal advice. Legal notices to StreamLien must be sent to support@streamlien.com (or to any updated legal-notice address posted on the website). StreamLien may provide notices to you by email to the address on your account, by posting on the website, or through the Service. You are responsible for keeping your contact information current.

Support availability. Support is provided as available during StreamLien’s ordinary business operations. StreamLien does not guarantee any response time and does not provide emergency, after-hours, or deadline-sensitive assistance. Do not rely on support availability to prepare, mail, serve, file, or record any document by any deadline. Support does not include legal advice, review of any document for legal sufficiency, or advice about deadlines, recipients, methods of notice or service, or lien rights.

You agree to contact support@streamlien.com and to allow StreamLien a reasonable opportunity to address any issue before initiating a chargeback or payment dispute, as further provided in Section 9.

Section 25

Changes to These Terms

StreamLien may update these Terms from time to time. The "Last Updated" date above reflects the most recent version, and the updated version is effective as of that date unless a later effective date is stated. Material changes may be communicated by posting on the Service, by email, or by other reasonable means. Your continued use of the Service after the effective date of any changes constitutes acceptance of the revised Terms. If you do not agree to the revised Terms, you must stop using the Service.

Section 26

Miscellaneous

Entire agreement. These Terms, together with the Privacy Policy and any additional product-specific terms presented to you, constitute the entire agreement between you and StreamLien regarding the Service and supersede all prior or contemporaneous understandings.

Severability. If any provision of these Terms is held invalid or unenforceable, that provision will be enforced to the maximum extent permissible and the remaining provisions will remain in full force and effect.

No waiver. StreamLien's failure to enforce any right or provision of these Terms is not a waiver of that right or provision.

Assignment. You may not assign or transfer these Terms or any rights under them without StreamLien's prior written consent. StreamLien may assign these Terms without restriction, including in connection with a merger, acquisition, or sale of assets.

Force majeure. StreamLien is not liable for any delay or failure to perform resulting from causes beyond its reasonable control, including acts of God, natural disasters, labor disputes, governmental actions, utility or internet failures, or third-party service failures.

Relationship of parties. Nothing in these Terms creates any partnership, joint venture, employment, agency, fiduciary, or attorney-client relationship between you and StreamLien.

Headings. Section headings are for convenience only and do not affect interpretation.

Electronic communications and signatures. You consent to conduct business with StreamLien electronically, and you agree that electronic records, disclosures, notices, agreements, and signatures satisfy any legal requirement that a communication or agreement be in writing or signed.

Interpretation. As used in these Terms, "including" means "including without limitation," and no rule of construction shall be applied against the drafting party.

Survival. Provisions that by their nature should survive termination or expiration of these Terms shall survive, as further described in Section 23.

Accessibility

StreamLien is committed to making the Service accessible to users with disabilities. If you have difficulty accessing any part of the Service or need assistance using the Service because of a disability, contact support@streamlien.com. StreamLien will make reasonable efforts to address accessibility issues and, where reasonably possible, provide an accessible alternative means of accessing the relevant information, document, or service. Additional accessibility information is available in our Accessibility Statement.
